BEFORE, INBETWEEN, AND AFTER 170lbs to 122lbs

wow what losers using your picture to exploit your weightloss that was not done by using their stupid acai berry. you look fantastic and a true example of weightloss by simple diet and exercise!
 
Hey, In your first post you mention that when you click on that add with a picture of you it takes you to an acai berry weightloss thing. Is that what you used to lose the weight?
 
I have been seeing so many pictures of people on those ads on MySpace from this site...makes me so sick and so MAD!!! These people all worked their butts off to get the body they deserved!!!!!!! My pictures are STILL up and being used..and i wrote a very long complaint to MySpace. Nice of them to respond back or get rid of them....GRRRRRRRRR!! I feel so bad for everyone who got their pictures stolen from them. Hopefully you will find a way to get your pictures off...as for me...im still trying but they keep popping up.

SPAM them??? Spreading bad words about them?

One tiny courage: That they using your pictures is not right. But that they use your pictures to convince people means that they agree with all of us.... YOU LOOK FANTASTIC NOW! You look even better than a film (commercial) star, that's probably why they used your pixies..!!

But I know... still not right what they did.... >.>

It just ticks me off they are using them saying that i took that crap to lose weight and if you take that stuff you can lose 40 some pounds in 3-4 weeks...ya right!! Thats so unhealthy! Thank you tho for the sweet comments!...Its really hard to TRY and get those ads down....ive tryed for a long time...and it seems whenever i do get one down..they just pop up again with more. GRRR!!

Yeh.... You worked so hard to loose weight.
The effort and time you put in... And people say you just use their diet thing to lose weight. Taking advantage of YOUR work and they like wiped your hard work for an ad...

Everytime I log in to myspace I get pissed off over and over seeing what those ad's are doing to you and Hondagirl, so I tried to look in to it and found some cases that seem to apply to the situation your both in, to help you maybe take legal action.

You have a good case for filing a complaint for the tort liability of invasion of privacy, which arises from four distinct kinds of activities: (a) intrusion into private matters; (b) public disclosure of private facts; (c) publicity placing a person in a false light; and (d) misappropriation of a person's name or likeness. [Hill v. National Collegiate Athletic Ass'n (1994) 7 Cal.4th 1, 24, 26 Cal.Rptr.2d 834, 848]

Misappropriation of person's name or likeness:
The elements of a common law cause of action for misappropriation of name or likeness are: "(1) the defendant's use of the plaintiff's identity; (2) the appropriation of a plaintiff's name or likeness to defendant's advantage, commercially or otherwise; (3) lack of consent; and (4) resulting injury." [Slivinsky v. Watkins-Johnson Co. (1990) 221 Cal.App.3d 799, 807, 270 Cal.Rptr. 585, 589 (emphasis added)]

Statutory action:
In addition to the invasion of privacy claim, anyone using another's "name, voice, signature, photograph or likeness" for commercial purposes without consent is liable for the injured party's actual damages or $750, whichever is greater. [See Ca Civil § 3344]
 
Ugh, that sucks. I can't even begin to imagine how violated you must feel :( If you'd like, I can show you how to watermark your pics (if you have Photoshop). Or heck, I'd even do it for you
 
Wow...you look gorgeous!! Sometimes I feel like it's impossible to ever get to where i'm thin, healthy, and happy but then I see before and after pics like yours and am reminded that it's possible as long as i'm willing to work hard. You are truly and inspiration and I look forward to one day being able to wear little sexy black shorts too =)

Oh ya i know what you mean...before i lost my weight..i never really had summer clothes..i wore jeans all year round and now im addicted to wearing shorts and skirts haha. I wish you the best of luck with reaching your goal!! :)
