Saw this today and recognized you... I hate how these companies steal photos for false advertising. Just wanted to let you know.

Hey...ya i found 2 of those stupid made up story sites with your pictures and they did the same thing with my pictures on myspace as they did to yours...i complained like a crazy person to myspace and to wherever i could to get my pictures down from that stupid ad. I feel so bad this has to happen to you too...everyone on this site should feel safe about putting their before and after pics..but now these dumbass people have to go around and use them for this false advertising. Here is what i found and im pretty sure you maybe already got them but im just letting you know if you dont.

Everytime I log in to myspace I get pissed off over and over seeing what those ad's are doing to you and Ktjean, so I tried to look in to it and found some cases that seem to apply to the situation your both in, to help you maybe take legal action.

You have a good case for filing a complaint for the tort liability of invasion of privacy, which arises from four distinct kinds of activities: (a) intrusion into private matters; (b) public disclosure of private facts; (c) publicity placing a person in a false light; and (d) misappropriation of a person's name or likeness. [Hill v. National Collegiate Athletic Ass'n (1994) 7 Cal.4th 1, 24, 26 Cal.Rptr.2d 834, 848]

Misappropriation of person's name or likeness:
The elements of a common law cause of action for misappropriation of name or likeness are: "(1) the defendant's use of the plaintiff's identity; (2) the appropriation of a plaintiff's name or likeness to defendant's advantage, commercially or otherwise; (3) lack of consent; and (4) resulting injury." [Slivinsky v. Watkins-Johnson Co. (1990) 221 Cal.App.3d 799, 807, 270 Cal.Rptr. 585, 589 (emphasis added)]

Statutory action:
In addition to the invasion of privacy claim, anyone using another's "name, voice, signature, photograph or likeness" for commercial purposes without consent is liable for the injured party's actual damages or $750, whichever is greater. [See Ca Civil § 3344]
 
I've just stumbled across this forum a few weeks ago --- first post --- and I've been seeing your pictures on myspace for months!! It makes me a little hesitant about posting progress pictures online - I don't want my pictures used as false advertising.... I guess it just goes to show why you have to watermark everything these days :rolleyes:

Hey I just wanted to tell you that you look absolutely fabolous. You're definately gonna turn heads wherever you go.

Also I was on my myspace page and when I looked to the top of the page, I saw an ad for the acai berry/colon cleanse diet. Now I saw that ad one hundred and one times before, but the only thing different about it was that it had your before and after pictures on it. I know right? Frickin jerks. But even if you knew already from someone else I felt like you needed to know.

Good job! , Hopefully i can do the same. i really just want to loose 20 pounds before summer. but that seems a little high of a goal since there is only 3 months till summers starts to come around..

Wow! You look amazing. You were beautiful even in the before photos but you look happier and more confident in the after photos so i think those are better :). Im so happy your doing great. Keep up the amazing work!
