Gym issues with my PT pack

OMG I think my head is going to explode!

Anyhow, for people who do not know what has been happening, please read the PT threads I have posted. But you won't need to if you don't want to hehehe

As most of you know, I have a PT at the gym I go to. He runs PT from home too. Recently he launched a Boot Camp in his area and me and another girl from the gym decided to do his boot camp instead of the gym's one. Well the gym manager wasn't happy with this (and I'm going to guess there are other stuff we don't know) and she sacked him.

I had recently bought a 12 pack and now I have 9 left. He told me that another guy is taking over his PT. I don't want to use the PT I have left, in fact I want to cancel it, get my money back and continue the PT with him in his area.

The day after when I went to the gym, the guy taking over S's PT told me S was gone and he was more than happy to take over. I said "What if I want to cancel it?" He said to talk to sales. As I was on an early shift, I couldn't and went to work.

So finally after a week the manager from the gym calls me and goes. "unfortunately, we had to get rid of Stuart. Paul is talking over Stuart's clients and I noticed you have a number of PT sessions left. Paul will sit down with you and figure out what you want to do and stuff. It's one free and then it continues with your PT pack. Now you train early in the morning, don't you? What day and time can you come in and see Paul?"

I said to her "I spoke to Paul last week. Didn't he tell you? I told him I want to cancel the PT" She was like "Oh, and why is that?" I said "Well, I want to continue training with Stuart and that's what I am going to do. He knows about my past (I didn't tell her about the bulimia, pregnancy and miscarriage, I don't think it's her place to know)" She then goes "I am very disappointed" which to I replied "Well it's not my fault you got rid of him"

Anyhow she rang back and said I can't get a refund. She also rang Stuart asking if I was getting it at a cheaper price (which I'm not, I haven't even bought a pack yet, I just told him that I will buy a pack next yr). I think this is ridiculous.

So that night I went into the gym to get a copy of the terms and conditions of the PT contract and try and get my money back ($360). Ex PT was there (yes, her again). She called Stuart a f'n prick and she said the manager was upset with the way I talked to her which was BS. The reason why she won't give me my money back is prolly because I'm the only one consistent with PT and keeps on buying it. I wasn't offered another PT. Stuart suggested I could always ask to transfer the money to my membership but if I was to fall pregnant and cancel the gym, I'd still lose the money.

So what do I do to get my money. It does say that PT packs are non refundable, however, because they sacked him don't I have some say in wanting my money back. I know they are softening the deal with offering an extra PT session but I don't want to go through the whole process of getting used to a new PT again, plus it's 9 sessions, not 2 or 3

"Non refundable" sounds pretty clear to me. It also sounds like Stuart deserved to be sacked. I would imagine there was a "non-compete agreement" that he violated. Sounds like the gym is being very nice to offer you an extra session.

Sorry, I know that is not what you want to hear, but this disinterested third party thinks the gym is 100% within their rights. My advice is to deal with it.
 
You're just stating your opinion, it's OK. lol. Obviously if I went into more detail, you would know the situation better and your opnion may be different.

They are only offering me the extra sessions because I have bought pack after pack of PTs. It has been never ending for the past year. That equals to alot of money. Like I said, it is to soften me up.

People have this impression of me as being quiet and agreeable just because I am short and keep to myself a bit more and people are often shocked when I do eventually open my mouth and tell them what I think. Even if I say it nicely, just because it is out of character, they seem to take offence to it

Well I went in yesterday and saw one of the PTs that is my age, we get on pretty well and asked her if she will finish off the pack. She said no problem and she isn't happy they got rid of Stuart either, like me, she thinks he did nothing wrong. So I asked the manager and she said it's ok :)

Keep in mind you are the customer, and the manager's job is to make you happy, if at all possible, not to get upset with how you spoke to her. That is a pretty arrogant attitude for a manager to take. I personally would take my business else where.
 
Glad it worked out that you got one that will be OK. That manager sounds like an idiot. That's the sort of thing best to spread the word about so others don't get treated so shabbily.

I disagree. Though her traing likely violated a non-compete clause and it led to his firing, PT contracts typically involve the client, PT, and gym. If the gym is forced to fire a PT, that's not an acceptable excuse to force a client to continue with a new trainer. And don't drink the Kool-Aid and take the extra session... it's a nonsense move not worth your time.

More than likely, the PT staff is doing and saying everything they can to keep you with them, rather than let you go somewhere else. If you take the issue up with your gym's corporate office, you should be able to make a case that you shouldn'y have to continue with the trainers available, because that wasn't part of the deal. I know clients that have used corporate to weasel out of PT for completely horrible reasons, so it shouldn't be hard to get out of your PT contract seeing as you have good reason.

Just out of curiosity, you don't belong to Life Time Fitness do you? Because besides trying to sell you a bunch of crap you don't really need, they often try to pull this kind of nonsense. Believe me, I worked at one for about half a year. It started out well as everything being all about the members, but it quickly turned into a rather petty situation.
